Questions
NIW, plainly.
Short answers to the questions we hear most. Your intake gets you a personal answer.
What is a National Interest Waiver (NIW)?
NIW is a green card category under EB-2 that lets an applicant self-petition. Instead of needing an employer job offer and labor certification, you show that your proposed work has substantial merit and national importance, that you are well positioned to advance it, and that waiving the job offer benefits the United States.
Do I need an employer to file an NIW?
No. NIW is a self-petition, so you do not need an employer sponsor or a labor certification. You do need to show a credible plan for your own work in the United States.
What are the minimum requirements?
NIW falls under EB-2, which generally requires an advanced degree or a bachelor’s degree plus five years of progressive experience, or exceptional ability in the sciences, arts, or business. Your intake helps us check whether your background meets these requirements.
What does the Dhanasar test ask?
The Dhanasar framework asks three questions: whether your endeavor has substantial merit and national importance, whether you are well positioned to advance it, and whether, on balance, waiving the job offer and labor certification would benefit the United States.
Is this intake legal advice?
No. Submitting an intake does not create an attorney-client relationship or guarantee any outcome. Our team reviews your information and talks through whether an NIW petition is worth pursuing.
